Appeal from a judgment of the Supreme Court at Special Term (Hughes, J.), entered August 28, 1980 in Albany County, which dismissed petitioners’ application, in a proceeding pursuant to CPLR article 78, to compel respondents to recompute reimbursement tuition rates for instruction of handicapped students without a retroactive ceiling on pedagogical staff salary increases. The petitioner Organization to Assure Services for Exceptional Students (OASES), is a nonprofit corporation comprised of approximately 25 private schools which have been approved by the Commissioner of Education to provide education for handicapped children for whom no adequate facilities exist in the public school system.
