According to the correspondence you have submitted, the FOIA requester in this instance seeks a copy of your "personnel record, specifically your "educational and professional background, including employment history and employment qualifications. . . ." Letter from J.L. Ophof to C. Bailey, Department of Information Systems (April 22, 2004). You state that you have requested that your employer not release this information.
RESPONSE:
Not having viewed the actual records, I cannot opine definitively concerning the release of any particular document(s). As a general matter, however, it is my opinion that records containing information reflecting employees' educational and professional experience and qualifications constitute "personnel records" that are open to public inspection and copying under the FOIA. This follows from this office's consistent view that resumes are not exempt from disclosure under A.C.A. §
The existence of exceptions related to social security numbers (see Op. Att'y Gen.
(1) There has been a final administrative resolution of any suspension or termination proceeding;
(2) The records in question formed a basis for the decision made in that proceeding to suspend or terminate the employee; and
(3) There is a compelling public interest in the disclosure of the records in question.
Id.
As stated above, I cannot address the release of any particular records in this instance, not having seen the records or been apprised of the custodian's decision. The foregoing provides general guidance, however, in making the necessary determinations under the FOIA.
