Charles W. Harrell contracted to buy a tract of land of Margaret Neef for $3600, of which $1200 was to be cash. He took possession of the land but made no payment, contending that the title was defective. She recovered a decree for specific performance, with a provision that unless within a fixed time he should pay the amount of cash agreed upon and give security for the deferred payment she should have judgment against him for the amount of the agreed price, which should be a lien on the land.
