This is an appeal by the plaintiff in a common-law writ of certiorari, from the judgment of the circuit court dismissing the writ. The writ was to a justice of the peace, to bring up the record, etc., in a certain action tried before him, in which judgment had been rendered against the plaintiff in error, and in favor of the defendants in error. It was regularly allowed, sued out, served and returned. The circuit court, having heard the cause, dismissed the writ, and gave judgment against the plaintiff in error for costs. The question is upon the regularity of this judgment. We think it was irregular. Judgment of dismissal is only proper for
