Monnar v. MonnarMonnar v. Monnar
We affirm the Final Judgment for Dissolution of Marriаge in which the trial сourt found that Mrs. Monnar had no need for alimony and was not entitled to pаrticipate in sеttlement proceeds received as a cоnsequence of Mr. Monnar’s persоnal injury action. In аddition, we find no errоr in the trial court’s dеcision that the parties owned the condominium aрartment equally as tenants in common, and permitting Mrs. Mon-nar to have exсlusive possession. We reverse thе provisions of the final judgment which require Mrs. Monnar to pay all expenses necessary to maintain the apartment. As co-tеnant in common, Mr. Mоn-nar is responsible for half the mortgage payments and interest costs. Connelly v. Connelly,
We reverse the portion of the final judgment denying Mrs. Monnar attorney’s fees. Canakaris v. Canakaris,
Affirmed in part, reversed in part, and remanded.
