In an action to recover damages for malicious prosecution, the plaintiff appeals, as limited by his brief, from so much of an order of the Supreme Court, Westchester County (Nastasi, J.), entered June 10, 1988, as, inter alia, granted that branch of the defendants’ cross motion which was to dismiss the complaint for failure to state a cause of action.
Ordered that the order is affirmed insofar as appealed from, with costs.
Moreover, the record reveals that the underlying criminal action was initiated by the defendant Mrs. Mondello with probable cause inasmuch as she had been harassed by her estranged husband who damaged an automobile owned by the codefendant while it was in her possession. The resulting charge of criminal mischief in the fourth degree was thus not unwarranted, unlike the case in Levine v Gurney (
Finally, in light of the foregoing there is no merit to the plaintiffs argument, advanced for the first time on appeal, that he should be granted leave to serve an amended complaint (CPLR 3211 [e]; see, Bardere v Zafir,
