Appeal from a judgment of the Supreme Court at Special Term, entered September 10,1979 in Albany County, which dismissed the petition, in a proceeding pursuant to CPLR article 78, to review a determination of the Commissioner of Education. Petitioner, a tenured teacher in the Duanesburg Central School District, was suspended without pay during the 1978-1979 academic year after a hearing panel found her guilty of levied charges of neglect of duty, insubordination and conduct unbecoming a school teacher. The Duanesburg Board of Education, believing that the penalty should be outright dismissal, appealed to the Commissioner of Education to review the panel’s findings (Education Law, § 310).
Petitioner did not challenge the validity of the hearing panel’s findings of fact as to her guilt in the administrative proceeding below.
