State, 39 Ala.App. ‍​​​‌​‌​​‌‌‌​‌​‌‌​‌​‌‌​​‌‌‌​‌‌​​‌​​​‌​‌​​‌​‌​‌‌‌‌‌​‌‌​‌‌​‌‌​​​​‌‌‌‌​‌​​​​‌‌​‌​​​‌‌‌‌‌​​​​‌​​​​​‌​‍584, 105 So.2d 711.
