An examination of this case has led us to the conclusion that the same was correctly decided at the circuit, both in regard to the merits and the law applied thereto. The opinion of the learned justice, delivered upon the decision, seems to contain all which is necessary to be said in disposing of the appeal. The judgment should be affirmed, with costs.
