That branch of the motion seeking to dismiss the appeal taken from the order entered on May 29, 1961, is granted, with $10 costs unless the appellant perfects and notices the appeal within 30 days from Special Term’s decision of appellant’s motion to set aside the order entered on May 29, 1961.
