The plaintiff brought action upon a promissory note against Sam Bardler and Zachariah Eh Berlin (“the name ‘Zachariah’ being fictitious, real first name being unknown to plaintiff ”). The plaintiff did not summon Bardler, but obtained a judgment against Berlin by default.
