This action was brought to recover the sum of $130, being the amount of rent due upon a lease of real estate. On April 1, 1890, Moses Merrick leased to one Edward P. Hill certain premises in the city of Rochester and town of Gates, for one year next ensuing, at the annual rental of $215, payable quarterly on the 1st days of July, October, January, and April. Indorsed upon the lease is the following: “For value received, we do hereby guaranty the payment of rent of the foregoing premises as hereinbefore agreed to be paid by said lessee, Edward P. Hill;” dated Rochester, April' 1, 1890, and signed by the defendants in this action.
