State, 50 Ala.App. 465, 280 ‍​‌‌‌​​‌​​‌‌​​‌‌​‌‌​‌‌​‌‌‌​‌​​‌‌​​‌​​​​‌‌​‌‌‌‌​‌​​​‌‌​​‌‌​​‌‌‌‌​‌‌​​​​‌‌‌​​​​‌​‌‌​​‌​​​‌​​​​‌‌‌​‌‍So.2d 171 (3 Div. 159).
