It is alleged in the complaint that it was agreed between the plaintiffs and' the defendant Hyde, at the time their accounts and dealings under the contract were adjusted, and. the balance struck, and the notes given, that if anj' of the lands proved on examination not to be such as the contracts called for, or as they were represented by Hyde, .with reference to the quantity or quality of the timber growing
The complaint being thus substantially defective, it follows that the order of the court below, sustaining the demurrer, must be affirmed.
