Ala. GenLR 72(a) and dated ‍‌​​‌‌​​‌‌​‌‌‌​​‌‌‌​‌​‌​‌​​​‌‌​‌‌​​​‌‌​​‌‌‌‌‌‌​​​‍April 23, 2025, (Doc. 10), is ADOPTED as the opinion of this Court. Accordingly, it is ORDERED that Defendants’ motion to dismiss, (Doc. 3), is GRANTED in part and DENIED in part as follows:

  • GRANTED as to Count One against USA Board of Trustees under Fed. R. Civ. P. 12(b)(1).
  • GRANTED as to Count Two against Charles Smith for ‍‌​​‌‌​​‌‌​‌‌‌​​‌‌‌​‌​‌​‌​​​‌‌​‌‌​​​‌‌​​‌‌‌‌‌‌​​​‍claims under Title VII pursuant to Fed. R. Civ. P. 12(b)(6).
  • Otherwise DENIED.
