The plaintiff sued the defendant in an action of trespass, alleging that he was the owner and in possession of a described parcel of land, and that the defendant had entered thereon and was cutting and removing timber therefrom. The plaintiff did not claim to have a perfect paper title to the property, but relied upon a tax deed as color of title, under which he claimed to have been in possession for more than seven years.
