Martin v. Louisiana Stadium & Exposition District

337 So. 2d 515 | La. | 1976

Lead Opinion

In re Wade O. Martin, Jr., and The Louisiana Stadium and Exposition District et al. applying for Supervisory Jurisdiction and Writ of Certiorari.

Writ refused. The showing made does not warrant the extraordinary intervention of this court, especially in view of the fact that the trial judge has attested that he can give the case an expeditious hearing.

Concurrence Opinion

SUMMERS, J.,

concurs and is of the additional opinion that the applicants have too long delayed the prosecution of this litigation to now seek the extraordinary relief prayed for.

Dissenting Opinion

CALOGERO, J.,

recused for the reason that while a practicing attorney he rendered counsel to one of the litigants herein with respect to one of the legal issues involved in this application; namely, applica-bilities of the public bid law to the LSED before adoption of the 1974 La. Constitution.
