It is true that the allegations in the petition determine the amount in controversy, but such allegations must be allegations of fact and not the mere conclusions of the pleader; and, If the facts alleged show that the party is not entitled to recover more than a given amount, the allegations of additional facts, upon which it is apparent from the face of the petition he is not entitled to recover, does not give jurisdiction. The district court having no jurisdiction to try this case, the case is reversed and remanded, with instructions to the district court to dismiss the same.
Reversed, with instructions to dismiss.
