Motion by the defendant to dismiss the complaint for failure to state facts, et cetera, denied with ten dollars costs. The action is brought to recover overtime compensation under the provisions of the Fair Labor Standards Act of 1938 (U. S. Code, tit. 29, § 201 et seq.).
