Gilbert, J.

1. The court did not err in overruling the demurrer to the indictment.

2-. The. ground of the motion for a new trial complaining of a portion of the- charge of the court is without merit, for any reason assigned.

3. The evidence supports the verdict of guilty.

Judgment affirmed.
