McMILLAN, Judge.

Based on the Alabama Supreme Court’s decision in Ex parte Lucas, 792 ‍​‌‌‌‌​‌‌‌​‌​‌​​‌‌​‌‌​‌​​​‌‌​‌​‌‌​‌‌​‌​​‌‌​‌‌​​​‌​​​​‌‌​‌​​‌​‌‌‌‌​​​‌‌‌​​​‌‌​‌​‌‌‌​​‌​​​‌‌‌‌‌‌‌‌​‍So.2d 1169 (Ala.2000), and the caselaw relating to civil cases cited therein, ‍​‌‌‌‌​‌‌‌​‌​‌​​‌‌​‌‌​‌​​​‌‌​‌​‌‌​‌‌​‌​​‌‌​‌‌​​​‌​​​​‌‌​‌​​‌​‌‌‌‌​​​‌‌‌​​​‌‌​‌​‌‌‌​​‌​​​‌‌‌‌‌‌‌‌​‍we remand the case to the trial court for that ‍​‌‌‌‌​‌‌‌​‌​‌​​‌‌​‌‌​‌​​​‌‌​‌​‌‌​‌‌​‌​​‌‌​‌‌​​​‌​​​​‌‌​‌​​‌​‌‌‌‌​​​‌‌‌​​​‌‌​‌​‌‌‌​​‌​​​‌‌‌‌‌‌‌‌​‍court to enter a judgment of acquittal.

REVERSED AND REMANDED.
