In our February 2, 2012, 670 F.3d 127, opinion (“Opinion“) in the above-captioned appeal, this Court set forth (1) its affirmance of certain parts of the district court‘s judgment, (2) its vacatur of certain other parts of the judgment, and (3) its conditional rulings on the remaining parts of the judgment, dependent on certain elections to be made by plaintiff-appellee-cross-appellant (“Plaintiff“) in this Court and on remand in the district court.
