McMILLAN, Presiding Judge.

Pursuant to the Alabama Supreme Court’s opinion in Ex parte Looney, 797 So.2d 427 (Ala.2001), the judgment in this case is reversed, and the cause remanded ‍​‌‌‌‌​‌‌​‌​​​​​‌‌​​​​​​‌​​‌​​​​​​​​‌​‌‌‌‌​‌​‌​‌​‍to the trial court for proceedings consistent with that opinion.

REVERSED AND REMANDED.
