This action was brought to recover wages for services rendered by plaintiff as chief mate on the bark Callao, and also, as alleged in the second cause of action, to recover double salary for waiting time under the provisions of the United States Revised Statutes, section 4529. On a retrial of the action, therefore, it will be the duty of the court to submit to the jury for their determination the extent of the waiting period to which the seaman was subjected, and to compensate him at the rate prescribed by the statute. The judgment appealed from is, therefore, reversed and a new trial is ordered, with costs to appellant to abide the event.
