Judgment reversed and a new trial granted, with costs to abide the event, unless the plaintiff stipulate to reduce the recovery by the sum of $1,930.40, as of the date of the report of the referee; and in case such stipulation be given the judgment is affirmed for the sum of $5,612.04, without costs of this appeal to either party.
