This was an action brought by the plaintiffs, as executors upon the estate of James Amoss, deceased, against the defendant, on 'an alleged promise and undertaking by the latter to purchase of the plaintiffs a certain described execution against Harris, which belonged to the plaintiffs, and to pay them therefor the sum of $1,000 00, with interest on the same
After a careful review of .the evidence contained i'n the record, the verdict of the jury, in our judgment, does substantial justice between the parties,'and we will not, according to the repeated rulings, of this court, interfere to control the discretion of the court below in overruling the motion for a new trial on the grounds of error alleged therein.
Let the judgmeut of the court bel.ow be affirmed.
