Order and judgment (one paper), Supreme Court, New York County (Harold Tompkins, J.), entered March 23, 1995, after a nonjury trial, inter alia, declaring that so long as the Department of Housing and Urban Development holds or insures a mortgage on the properties of plaintiff Grand Street Corporations, the pastor of the Church of St. Mary shall have the authority and responsibility of appointing the directors of the Grand Street Corporations, directing plaintiffs to cease and desist from holding themselves out as directors of the Grand Street Corporations, and declaring that defendants Neil Connolly, Edward Byrne, Kevin Cronin, Kevin O’Brien and Shawn De Munnick are the lawful directors of the board of the Grand Street Corporations, unanimously affirmed, without costs.
