Jones was*indicted for being present, aiding and abetting one Ro* berts, in the murder of Hibler, a watchman of the city, and was Iried and convicted.

The testimony in the ease is the same as in the case of Roberts vs. The State, and the instructions similar. The judgment will be reversed and the cause remanded.
