Jones ‍‌‌‌‌‌‌​​‌‌‌‌​​​​​​‌​​‌‌​​‌​​‌​‌‌‌‌‌‌​​​‌‌‌‌‌‌​‌​‌‌​‌‌​‌​​‌‌​‌​‌​​‌​​​​​‌‌​​​​‌​‌‌‌​‌‌‌‌​​​‌​‌‌​‌‍was*indicted for being present, aiding and abetting one Ro* berts, in the ‍‌‌‌‌‌‌​​‌‌‌‌​​​​​​‌​​‌‌​​‌​​‌​‌‌‌‌‌‌​​​‌‌‌‌‌‌​‌​‌‌​‌‌​‌​​‌‌​‌​‌​​‌​​​​​‌‌​​​​‌​‌‌‌​‌‌‌‌​​​‌​‌‌​‌‍murder of Hibler, a watchman of the city, and was Iried and ‍‌‌‌‌‌‌​​‌‌‌‌​​​​​​‌​​‌‌​​‌​​‌​‌‌‌‌‌‌​​​‌‌‌‌‌‌​‌​‌‌​‌‌​‌​​‌‌​‌​‌​​‌​​​​​‌‌​​​​‌​‌‌‌​‌‌‌‌​​​‌​‌‌​‌‍convicted.

*413The testimony in the ease is the same as in the case ‍‌‌‌‌‌‌​​‌‌‌‌​​​​​​‌​​‌‌​​‌​​‌​‌‌‌‌‌‌​​​‌‌‌‌‌‌​‌​‌‌​‌‌​‌​​‌‌​‌​‌​​‌​​​​​‌‌​​​​‌​‌‌‌​‌‌‌‌​​​‌​‌‌​‌‍of Roberts vs. The State, and the instructions similar. The judgment will ‍‌‌‌‌‌‌​​‌‌‌‌​​​​​​‌​​‌‌​​‌​​‌​‌‌‌‌‌‌​​​‌‌‌‌‌‌​‌​‌‌​‌‌​‌​​‌‌​‌​‌​​‌​​​​​‌‌​​​​‌​‌‌‌​‌‌‌‌​​​‌​‌‌​‌‍be reversed and the cause remanded.
