On the authority of Thomas v. State, 75 South. 821, 1 present term, the judgment of the circuit court is reversed, ‍​‌‌​‌​​‌​​‌​​‌​‌​‌‌​‌​​​‌‌​​​‌​‌‌‌‌‌​​​​​​‌‌​‌​‌‍and a judgment here rendered discharging the defendant.

Reversed and rendered.
