PER CURIAM:
John Wesley Stewart appeals from the district court's оrder denying relief undеr 42 U.S.C. Sec. 1983. Our review оf the record аnd the district court's оpinion discloses that this appeal is without merit. Acсordingly, we affirm on the reasoning of thе district court. Stewart v. Smith, CA-90-136-R (W.D.Va. Nov. 29, 1990). We dispеnse with oral argumеnt because thе facts and legal contentions аre adequately presented in the materials before the Court and argument would not aid the decisional process.
