It appears from the record that the courr sustained the defendant’s objection to th,e question propounded to the witness Thrasher, which is made the basis of the fifth assignment of error.
The record does not contain the oral charge of the court, and the trial court will not be put in error for refusing to give a written charge where the oral charge is not set out in the record.
The record appears in this ease to be regu *492 lar; there is no reversible error, and the judgment is affirmed.
