James Raynor, Sr. v. Mack Bailey, Jr.James Raynor, Sr. v. Mack Bailey, Jr.

Court of Appeals for the Fourth Circuit
Aug 31, 2026
25-6589

PER CURIAM:

James Herman Raynor, Sr., a Virginia inmate who filed a 42 U.S.C. § 1983 action alleging violation of his Eighth Amendment rights, appeals the district court‘s order denying Raynor authorization to proceed in forma pauperis because Raynor is a three-striker under the Prison Litigation Reform Act. Upon de novo review, see Holley v. Combs, 134 F.4th 142, 144 (4th Cir. 2025), and “accept[ing] [Raynor‘s] well-pleaded allegations as true at this stage of the proceedings,” id. at 145, we conclude that Raynor sufficiently alleged that he is “under imminent danger of serious physical injury” to satisfy the exception to the three-strikes rule. See 28 U.S.C. § 1915(g).

Accordingly, we vacate the district court‘s order and remand for further proceedings consistent with this opinion. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process.
