FORET, Judge.

For reasons handed down this date in the companion case of Tolbert et al. v. Ryder et al., La. Third Circuit Court of Appeal, 345 So.2d 548, the judgment of the trial court is affirmed with the amendment made in Tolbert.

AMENDED AND AFFIRMED.
