Inasmuch as this application to quash a subpœna duces tecum was made in the Supreme Court, it is a civil proceeding, and is accordingly appealable (People v. "Doe" [Byk], 247 A.D. 324" court="N.Y. App. Div." date_filed="1936-03-24" href="https://app.midpage.ai/document/people-v-doe-5343860?utm_source=webapp" opinion_id="5343860">247 A.D. 324, affd. 272 N.Y. 473" court="NY" date_filed="1936-07-08" href="https://app.midpage.ai/document/people-v-rogas-3600974?utm_source=webapp" opinion_id="3600974">272 N.Y. 473; Matter of Ryan [Hogan], 306 N.Y. 11" court="NY" date_filed="1953-07-14" href="https://app.midpage.ai/document/matter-of-ryan-hogan-2568713?utm_source=webapp" opinion_id="2568713">306 N.Y. 11; Civ. Prac. Act, § 588, subd. 1, par. [a]).

The Appellate Division has dismissed the appeal, but in its opinion stated that if it "had jurisdiction to entertain the appeal *1045 on the merits, it would affirm the order". We agree that the Special Term order should be affirmed (Matter of Manning v. Valente, 272 A.D. 358, affd. 297 N.Y. 681" court="NY" date_filed="1947-11-13" href="https://app.midpage.ai/document/matter-of-manning-v-valente-3578152?utm_source=webapp" opinion_id="3578152">297 N.Y. 681; Matter of Mohawk Overall Co., 210 N.Y. 474" court="NY" date_filed="1914-03-17" href="https://app.midpage.ai/document/matter-of-mohawk-overall-co-3598860?utm_source=webapp" opinion_id="3598860">210 N.Y. 474, motion to dismiss granted 235 U.S. 685" court="SCOTUS" date_filed="1914-10-26" href="https://app.midpage.ai/document/commonwealth-trust-co-v-trocon-8142964?utm_source=webapp" opinion_id="8142964">235 U.S. 685).

Accordingly, the order of the Appellate Division should be reversed and that of Special Term affirmed, with directions to Special Term to fix a new return date.

Ordered accordingly.
