As the Court of Appeals says in Matter of McMillan (218 N.Y. 64" court="NY" date_filed="1916-04-25" href="https://app.midpage.ai/document/in-re-the-estate-of-mcmillan-3616054?utm_source=webapp" opinion_id="3616054">218 N. Y. 64, at p. 69): it has often been held that a jury or other triers of fact need believe a witness only so far as they deem his testimony credible.”

The report of the referee is, therefore, in all respects confirmed.

Proceed accordingly.
