It is averred in the petition, and admitted by the answer of the executor, that Carsten H. Meyer was duly appointed executor of the last will and testament of John D. Meyer, deceased, on the 28th day of February, 1890 ; that the will of the testator was admitted
The order should, therefore, be affirmed, with ten dollars costs and disbursements.
Patterson, O’Brien and Laughlin, JJ., concurred; Van Brunt, P. J., dissented.
