This is a contested accounting proceeding, wherein it has been properly determined by the referee that the proved debts and administration expenses exceed the value of the personal property. The matter comes before the surrogate upon exceptions to the referee’s report. He reported that the real property of the decedent should be sold. Application therefor was made by the administrator in this accounting proceeding. The exception that this proceeding was not commenced in time is overruled. The
