This isa petition for the review of an order made by the referee, in effect adjudging that a certain mortgage executed by the bankrupt to the petitioner, on March 22, 1902, is void .as against the trustee; the referee finding that such mortgage was executed within four months prior to the filing of the petition in bankruptcy, with the intent and purpose on the part of the bankrupt to hinder, delay, and defraud his creditors.
Subdivision “e” of section 67 of the bankruptcy act (Act July 1, 1898, c. 541, 30 Stat. 564 [U. S. Comp. St. 1901, p. 3449]) provides that a conveyance or incumbrance of his property by a person adjudged a bankrupt, within four months prior to the filing of the petition, “with the intent and purpose on his part to hinder, delay, or defraud his creditors, or any of them, shall be null and void as against the creditors of -such debtor, except as to purchasers in good faith and for a present fair consideration.” The'mortgage here in question was executed On .March 22, 1902, and the petition upon which the adjudication in bankruptcy is based was filed July 22, 1902. The order of the referee is affirmed.
