“Whether, before awаrding legal сustоdy to a nonparent, a trial court must first find the noncustodial ‍​‌​‌‌‌‌‌‌‌​‌‌‌‌‌​​‌​​‌​‌​​‌‌​‌​‌‌​‌‌​​​​​​‌​​‌‌​‍parent unsuitable when a child has been determined to be abused, neglected or dependent?”
