Again, there would seem to be no doubt, that appellant could show by rebutting evidence, and hе could show in no other way, that the assessment was unconstitutional. And if he shоuld show that, it would, in effect, be to show that no assessment was made, as аn act in conflict with the organic law is the same as if it had not been done. It is insisted, that this assessment is liable to the same objection as that in thе City of Chicago v. Larned,
Judgment reversed.
