Order unanimously modified by striking out all defenses and the counterclaim excepting the matter pleaded as the fourth and sixth separate defenses, and as so modified affirmed, with $20 costs and disbursements to the appellant, with leave to the defendant-respondent to plead over as to the counterclaim on payment of said costs.
