This is an action by the plaintiff to recover the value of certain personal property alleged to have been taken and converted by the defendants. A verdict was directed for the plaintiff, and judgment entered thereon. From this judgment and an order denying a new trial the defendant, the Sioux Falls Candy Company, appeals to this court. In their answer to the complaint, the defendants, including the Sioux Falls Candy Company, justified the seizure and sale of the property under and by virtue of an execution issued out of a justice’s court upon a judgment recovered by the said Sioux
