The appeal from the intermediate order must be dismissed because the right of direct appeal therefrom terminated with the entry of the judgment in the action (see Matter of Aho, 39 NY2d 241, 248 [1976]). The defendant demonstrated his right to summary judgment by establishing, prima facie, that he did not make a special use of the area in question, and, in opposition, the plaintiff failed to raise a triable issue of fact (see Winegrad v New York Univ. Med. Ctr., 64 NY2d 851 [1985]).
The plaintiff‘s remaining contention is without merit.
