Action to recover broker’s commissions which plaintiff claims to have earned through finding a. purchaser, ready, able, and willing to purchase defendant’s farm in accordance with terms fixed by defendant. Verdict and judgment were for plaintiff, and defendant has appealed from the judgment and from an order denying a new trial. .Such appeal presents three questions.
“If in such a case the agency is terminated on the very eve of its successful culmination, the time of the revocation is a strong indication of bad faith on the part of the employer, and unless such inference is rebutted by other evidence, the employer will be held liable.”
The trial court did not err in refusing to direct a verdict for defendant.
The judgment and order appealed from are affirmed.
