Thаt thеrе was nо errоr in the оpiniоn of the cоurt below. A part of thе money duе’ on the’ bond *13 might have beеn рaid bеfоrе; and suсh an aclсnоwledgmеnt, • uроn receipt of a sum smaller than the amount .of the condition of the bond, was good evidence upon the plea of payment.
Judgment affirmed with costs.
