The opinion of the court was delivered by

Rogers, J.

— After a careful examination of the exceptions taken on the argument, we are decidedly of the opinion the' case is properly ruled, on all the points. As nothing occurs to my mind, calculated to throw additional light on the views, so well expressed ■by Judge Hepburn, the judgment is affirmed, for the reasons given in the charge.

Judgment affirmed.
