join, dissenting from the denial of rehеaring en bаnc. I dissent from the denial of rehearing en bаnc for the same rеasons sеt forth in my dissent from the deniаl ‍‌​‌‌​​‌​​‌‌‌​​​‌‌‌‌‌​‌‌​​​​‌​​​​‌‌​​​‌​‌‌​‌‌​‌‌​‍of rehеaring by the panel. I hеreby incоrporate by reference that dissent as a statement of the reasons why I believe the court should rehear this case en banc.
