No. 55489

Lead Opinion

In re: Hazel Gentry Gregory applying for certiorari, or writ of review, to the Court of Appeal, Second Circuit, Parish of Caldwell. 300 So.2d 213.

Writ denied. The judgment of the Court of Appeal is correct.

Dissenting Opinion

BARHAM, J.,

is of opinion the writ should be granted. The public policy of protecting community property interests is not applied equally upon dissolution by demise and dissolution by divorce. The public records doctrine can be applied equally —to protect community interest — or protect third party purchasers of immovables.
