It was error to refuse the testimony of Oscar Southwick touching the dying declaration ‍​​‌​​​​​​‌‌​‌‌‌‌​​​​‌‌‌​​‌‌‌‌‌​‌‌‌​‌‌​​​​​​‌‌​‌‌‍of William Gordon, who was killed by appellant, for which he is indicted.

Reversed and remanded.
