Granting Patent Owner’s Motion to Withdraw Counsel and Substitute New Counsel

37 C.F.R. § 42.10

On July 30, 2026, Patent Owner filed a Motion for withdrawal and substitution of counsel, seeking to withdraw the appearances of Timothy Cremen as Lead Counsel and James Gatto as Back-up Counsel in the above-captioned proceeding. Paper 52. Patent Owner further requests designation of Eric A. Zelepugas (Registration No. 73,302) as Lead Counsel and Robert A. Conley (Registration No. 55,846) as Back-up Counsel. Id. at 1; Ex. 3104.

According to the Motion, Petitioner does not oppose. Paper 52 at 1.

In consideration of the foregoing, it is hereby:

ORDERED that the Motion is granted with respect to the withdrawal of Timothy Cremen as Lead Counsel and James Gatto as Back-up Counsel;

FURTHER ORDERED that the Motion is granted with respect to the designation of Eric A. Zelepugas as new Lead Counsel and Robert A. Conley as new Back-up Counsel;

FURTHER ORDERED that Patent Owner shall file a Power of Attorney in the subject proceeding within three (3) business days of the date of this order;1

FURTHER ORDERED that Patent Owner shall file updated Mandatory Notices identifying these changes in counsel in accordance with 37 C.F.R. § 42.8(b)(3) within three (3) business days of the date of this order; and

FURTHER ORDERED that Patent Owner’s correspondence address in this case shall be changed to the following:

We note that Patent Owner’s new counsel already filed a Power of Attorney and updated Mandatory Notices (Ex. 3104), but did so through the Board’s online filing system as if Patent Owner were newly entering the case for the first time. Because Patent Owner already had counsel of record, these documents were not entered in the record. Thus, Patent Owner’s new counsel shall re-file these documents.
